Introduction
The following terms and conditions form the basis upon which I (the instructor) offer driving tuition to you (the student/customer).
General conduct
I will be courteous, polite and punctual. I will always behave in a professional and ethical manner. My training car will be well maintained, clean and tidy (weather permitting). My car is fitted with dual controls and is fully insured for driving tuition purposes. I will not use your lesson time for any form of personal business, without your expressed consent.
Qualifications
I am legally authorised, and fully approved and qualified to give driving tuition in the UK by the Driver and Vehicle Standards Agency (DVSA).
Driving License and eyesight
As required by law, you must hold a current, valid driving license (provisional or full), which must be produced on or in advance of your first lesson. You must also show that you can read a registration plate at a distance of 20.5 metres (67 feet). If you
need contact lenses or glasses to achieve this, you must make sure that you wear them on every driving lesson.
Driving under the influence
To ensure the safety of you and other road users, I reserve the right to cancel any lesson if you are, or I suspect you are, under the influence of any drugs and/or alcohol (prescribed or otherwise). If this occurs, the full lesson fee will be charged.
Safety, comfort and well being
Safety in my car is a shared responsibility. As such, you are advised to wear suitable footwear and clothing. It is important that you always act responsibly and give your undivided attention to the driving task at hand. Should anything be distracting you during your lesson it is important that you make me aware, even it is something that I am doing.
Lesson changes and punctuality
You will be required to pay for any lessons which are postponed or cancelled by you, especially if I am unable to obtain replacement work for the given time. However, I reserve the right to postpone or cancel any lesson if I consider the weather or road conditions to be unsuitable or
dangerous, or if I experience car trouble which prevents me from working. Unfortunately, I cannot be held responsible for any costs incurred as a result of me having to make lesson changes, for whatever reason.
I will normally wait for a maximum of 15 minutes before the lesson is abandoned and charged in full. A reciprocal waiting time may become necessary if I am delayed due to unforeseen circumstances. I will make up any lost lesson time as soon as possible.
Payments
A deposit is to be paid when your booking is accepted. This is calculated in accordance with the selected course. The balance is then due in full 14 days before the commencement of training. Any payment is non refundable once the booking has been accepted by me. At this point, a binding agreement is made between you and me.
All lessons must be redeemed within 6 months of payment, unless otherwise agreed.
Your entitlement to drive
As of June 2015, the paper counterpart driving license was abolished.
Any endorsements or driving bans will now only be visible online. For insurance purposes, I will be required to check your full license details, in order to ensure that you are eligible to take driving lessons. I will explain fully what is required for this check to be completed.
This is to protect you, me, and the general public.
The Driving Test
Driving tests always take priority over other lessons, where they have been agreed by me. Therefore, your lesson may be postponed or cancelled to allow for someone else’s driving test, or vice-versa. These changes will be communicated by me immediately.
Any test bookings must be made known to me as soon as they are known to you, otherwise I cannot guarantee to provide a vehicle for the test, or any lessons prior to it. All practical driving tests should be booked for Newport (Gwent), unless otherwise agreed.
In the interests of customer and public safety, I reserve the right to withhold the use of my training car for the test if, in my professional opinion, your driving is actually or potentially dangerous.
Three clear working days’ notice are required by the DVSA should you want to cancel or make amendments to your driving test. Failure to provide such notice will result in the loss of your test fee. I cannot be held responsible for any postponement or cancellation of any tests by either you or the DVSA, or any subsequent charges incurred.
Your statutory rights
I have a statutory obligation to provide you with services fit for the purpose for which they were bought and described. Nothing in these terms and conditions will reduce your statutory rights. If you have any doubts about your statutory rights, please contact your local Trading Standards Agency or Citizen’s Advice Bureau.
